Welcome to SoundTach. These Terms of Service ("Terms") govern your use of the SoundTach mobile application (the "App") operated by SoundTach ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you do not agree with any part of these Terms, you must not use the App.
2. Description of Service
SoundTach is a mobile application that uses audio analysis to estimate engine RPM from exhaust sounds. The App is intended for informational and educational purposes only.
Important Disclaimer
RPM readings provided by SoundTach are estimates based on audio analysis and may not be accurate in all conditions. The App should not be used as a substitute for professional diagnostic equipment or for safety-critical applications.
3. Trial and Purchase
Free Trial
We offer a 7-day free trial for new users. No credit card or purchase is required to start the trial. After the trial period, you will need to purchase the full unlock to continue using premium features.
Full Unlock Purchase
A full unlock of SoundTach can be purchased as a one-time payment. You can manage your purchase through your app store account settings.
Refunds
Refunds are handled according to the policies of the Apple App Store or Google Play Store, depending on your platform. Please contact the respective app store for refund requests.
4. Acceptable Use
You agree not to:
- ✕Use the App for any unlawful purpose
- ✕Attempt to reverse engineer, decompile, or disassemble the App
- ✕Circumvent any security features or access restrictions
- ✕Interfere with or disrupt the App or its servers
5. Intellectual Property
The App, including its design, code, graphics, and content, is owned by Xcarab and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUNDTACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
8. Safety Warning
Warning: When using SoundTach, please observe the following safety precautions:
- ⚠Never use the App while operating a vehicle or machinery
- ⚠Keep a safe distance from moving engine parts and exhaust systems
- ⚠Be aware of hot surfaces and exhaust gases
- ⚠Use appropriate hearing protection in loud environments
- ⚠Do not rely solely on the App for critical measurements
9. Indemnification
You agree to indemnify and hold harmless Xcarab and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App or violation of these Terms.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the modified Terms.
11. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination will remain in effect.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the United States.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
